By accessing or using the services provided by Shelly Ii Charters, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.
Important: These terms constitute a binding agreement between you and Shelly Ii Charters regarding the use of our marine services, including welding, fabrication, and charter operations.
2. Service Descriptions
Shelly Ii Charters provides the following services subject to these Terms of Service:
Marine Welding Services
Professional welding services for aluminum, steel, and stainless steel marine applications. All welding work is performed by AWS-certified professionals.
Offshore Fabrication
Custom metal fabrication including bow pulpits, radar arches, davit systems, and deck structures designed and built to marine-grade specifications.
Vessel Repair
Complete repair services including hull damage repair, engine foundation work, bulkhead restoration, and preventive maintenance programs.
Charter Services
Offshore charter experiences for fishing, diving, and recreational outings with fully crewed vessels and professional maritime guides.
3. Quotes and Pricing
Quote Validity
Quotes provided by Shelly Ii Charters are valid for 30 days from the date of issuance unless otherwise specified. After this period, quotes may be subject to revision.
Pricing Changes
Final pricing may vary based on actual work required. We will communicate any price changes before proceeding with additional work not included in the original quote.
Deposits
A deposit may be required to secure booking for fabrication projects or charter services. Deposit amounts and refund policies will be communicated at the time of booking.
Payment Terms
Payment is due upon completion of services unless other arrangements have been agreed upon in writing. We accept major credit cards and bank transfers.
4. Service Guarantees and Limitations
Workmanship Warranty
We stand behind our craftsmanship with a workmanship warranty on all welding and fabrication services. Specific warranty terms will be provided with your quote and depend on the type of work performed.
Exclusions
Our warranty does not cover damage resulting from accidents, misuse, normal wear and tear, or third-party modifications. Pre-existing conditions or damage may affect final results.
Third-Party Components
For parts and materials sourced from third-party suppliers, the manufacturer's warranty applies. We will provide documentation for any third-party components used in your project.
Charter Safety
All charter services are conducted with safety as the highest priority. Our crew reserves the right to cancel or modify trips due to weather conditions or safety concerns without liability.
5. Customer Responsibilities
Accurate Information
Provide accurate and complete information about your vessel, requirements, and contact details.
Access to Vessel
Ensure reasonable access to your vessel at agreed-upon times for service delivery.
Timely Communication
Respond promptly to communications regarding your project or service booking.
Payment
Complete payment according to agreed terms upon service completion.
6. Liability Limitations
Scope of Liability
Shelly Ii Charters' liability is limited to the cost of services provided. We are not responsible for indirect, incidental, or consequential damages including but not limited to lost profits or vessel downtime.
Insurance
Customers are responsible for maintaining appropriate insurance coverage for their vessels. While we maintain comprehensive liability insurance, we recommend customers verify coverage for their specific needs.
Force Majeure
We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including severe weather, natural disasters, or acts of third parties.
7. Intellectual Property
Design Rights
Custom designs created by Shelly Ii Charters remain our intellectual property unless otherwise agreed in writing.
Photography
We may photograph completed work for our portfolio and marketing purposes unless you request otherwise.
8. Cancellation Policies
Fabrication Projects
- More than 14 days: Full deposit refund
- 7-14 days: 50% deposit refund
- Less than 7 days: No refund
Charter Services
- More than 7 days: Full refund
- 3-7 days: 50% refund
- Less than 3 days: No refund
Weather Cancellations: Trips canceled due to unsafe weather conditions by Shelly Ii Charters will receive a full refund or the option to reschedule at no additional cost.
